Justice Ahmed Mohammed of a Federal High Court sitting in Abuja has nullified Clause 25, Section 15 of the Electoral Act Amendment Bill recently passed into law by the National Assembly, which re-ordered the sequence of the 2019 election.
The court declared that the 1999 Constitution empowers the Independent National Electoral Commission to organise and supervise elections, including fixing dates and sequence. The judge, therefore held that the National Assembly lacks power to override the actions of INEC.
Following the passage of the bill and its sending to President Muhammadu Buhari, the president had declined assent to it.
The National Assembly had moved to override the president’s veto. The move suffered a setback in the Senate as the senators could not mobilise enough support to override the president’s veto.
