Court of Appeal Dismisses Labour Party 2nd Application Against Dapo Abiodun

The Court of Appeal Ibadan, earlier today (Tuesday) dismissed the Labour Party’s (LP) application/2nd Appeal against the judgment of the Ogun State Governorship election Petition Tribunal delivered on the 21st June 2019.

The Labour Party had brought an application in Appeal No CA/IB/EPT/OG/GOV/M/2019 seeking the leave of the Appeal Court for extension of time to appeal against the Tribunal judgement in favour of the Governor Dapo Abiodun and APC.

The respondents counsel had challenged the jurisdiction of the appellate court on the ground that the Appellants/Applicants are out of time to appeal against the decision they seek to challenge and that the application is academic as the jurisdiction of the court is already abated before the said application was brought before it.

Their Lordships (Hon. Justices Jimi Olukayode Bada, H.T Tsammani and O Okoronkwo ) while dismissing the application, also warned the counsel to the Labour Party to abide by ethics of the profession by guiding against future abuse of court processes by way of frivolous application.
