Election Tribunal Dismisses Petition Against Oyo Lone PDP Lawmaker Odebunmi

By Adeola Oladele, Ibadan

The National Assembly Election Petition Tribunal sitting in Ibadan, Oyo State, on Tuesday upheld the victory of Hon. Segun Dokun Odebunmi, aka Bunvic, in the March 28 election.

Odebunmi, the only Peoples Democratic Party House of Reps. in Oyo State, was taken to the tribunal by the Labour Party candidate Hon. Isreal Ogundiran and Hon. Mathew Abioye of the All Progressives congress (APC), seeking the nullification of the results announced by INEC based on alleged malpractices and non-qualification to contest the election.

The three-man panel led by Justice Oluwatoyin Taiwo in its judgement said dismissed LP’s petition on the ground that the petitioner was unable to discharge the burden placed on him by the law, to prove that Hon. Odebunmi was not qualified to contest the election.

In the case of APC, the tribunal ruled that there was no concrete evidence enough to nullify the election as demanded by the petitioner, thereby dismissing the petition for lack of merit.

APC’s candidate Hon. Abioye had asked the court to nullify the election of March 28 in Ogo Oluwa/ Surulere federal constituency based on several cases of falsification of results, malpractices, rigging and non-compliance with the provision of
Electoral Act.

The tribunal said: ”The petitioner was only able to provide the catalogue of various election malpractices and false records without any concrete evidence to substantiate the claims.”

The Labour Party candidate Hon. Ogundiran and his lawyer Barr. Bolaji Agoro said they would study the judgment to know the next line of action while the APC candidate Hon. Abioye was absent at the court during the delivery of the verdict.

While reacting to the judgment,  Odebunmi said he dedicated his victory at the tribunal to God and the people of his constituency for their prayers and support for him.

He said the judgment would spur him to do better for the people of his constituency and work for the betterment of the opposition PDP, which he said would surely bounce back soon.

“I am optimistic that PDP will bounce back soon as the only legislator from Oyo State I am working with other stakeholders, particularly the PDP legislators in Abuja, to ensure we rebuild the party and by the grace of God, we will achieve something great,” he said.
