The Peoples’ Democratic Party Governorship Candidate in the August 9, 2014 election in Osun State, Senator Iyiola Omisore, has appealed the judgment of the Court of Appeal sitting in Akure, which affirmed the victory of Governor Rauf Aregbesola of the All Progressives Congress in the election.
The grounds of appeal are essentially the same with the ones filed before the Court of Appeal.
The two notices of appeal signed by his counsel, Dr. Alex Iziyon (SAN), has 14 grounds and 2 grounds respectively.
Omisore and PDP are expected to file their briefs of argument latest on the 24th of this month in fulfilment of the 10 days provided by the Supreme Court Rules.
Dissatisfied with the outcome of the August 9, 2014 in which Aregbesola was declared winner, Omisore and PDP had approached the State Election Petitions Tribunal to upturn the victory.
But the tribunal in the judgment delivered on February 6, 2015 dismissed the petition for lack of merit.
Dissatisfied with the tribunal judgment, Omisore and PDP also approached the Court of Appeal sitting in Akure, Ondo State.
The Appellate court in the judgment delivered on April 4, 2015 upheld the judgment of the lower tribunal and dismissed the petition in its entirety.
The Court of Appeal had held that the tribunal clearly fell into error when it entertained the petition that should have been dismissed at the preliminary stage for failure of the petitioners to file pre-hearing notice within the stipulated time.
